
Conditions for cooperation with MEXEM
1. Terms and conditions of cooperation with the carrier
The Carrier, performing services on behalf of MEXEM Sp. z o. o. (Principal) is obliged to:
- to carry out the transport service in accordance with the order, on the date and at the time specified,
- to use only vehicles which have all the necessary documents entitling them to carry out transport operations, and to have a current third-party liability insurance policy covering the transport being carried out for an amount of at least €200,000 for national transport and €250,000 for international transport,
- to have all the documents required by law and other legal regulations, correctly prepared, during the transport for the Principal,
- ensure that goods are transported in vehicles appropriate to the type of goods being transported; the required semi-trailer is leak-proof, with a customs bonded wire and a strong floor (a forklift must be able to enter),
- the use of technically sound vehicles for transport,
- supervise loading and unloading, check the quantity and condition of packages of consignments, the consignee's address and delivery times,
- immediately inform the Principal of any delays in loading, unloading, transport, as well as the driver's reservations regarding the quality of the goods, their quantity, packaging, damage,
- to take up and forward to the Consignee the documents relating to the consignment as directed by the Principal,
- maintaining telephone communication with the drivers of the vehicles during the execution of the order,
- the consignee's stamp and, if this is not possible, the legible signature of the person accepting the goods on the transport document and other documents confirming the handover of the goods. It is also necessary to obtain an entry of the date of return of the goods.
- Promptly notify the Principal of any accidents, issues or events that may affect the delivery of goods, and take all necessary measures to minimise any resulting damage or delay.
- To draw up an appropriate protocol in the event of damage or loss of goods, in the presence of a representative of the Consignee of the shipment, in accordance with legal regulations, in at least three copies, which shall be received by: Principal, Consignor of the consignment, Consignee of the consignment.
- To respect, during and after the transport contract, commercial confidentiality (information concerning clients, contractors, goods, prices, warehouses and their equipment, fleet, etc.),
- to comply with the rules arising from the Transport Law, the CMR Convention and other regulations applicable to road transport,
- to ensure that any reasonable remarks confirmed by the Consignor on loading or the Consignee on unloading the goods are entered in the Consignment Note/CMR.
- In the case of international transport, each haulier cooperating with MEXEM Sp. z o. o. is obliged to comply with the EU minimum wage requirements and to register their employees in the IMI system.
2. Provisions for the performance of the transport service:
- The basis for the transport service is the acknowledgement of the service order.
- The transport service is performed according to the consignment note/CMR issued on the basis of the order and in accordance with the carrier's requirements.
- MEXEM makes payment for transport services within 45 days from the date the carrier fulfils the requirements of the transport order. Payments are made every Wednesday for invoices whose due date falls in the week in which the payment will be made.
